2.1 Service Scope

DiagAutoClinic provides professional automotive diagnostic services including but not limited to:

• Vehicle diagnostics and fault code analysis
• ECU programming, flashing, and tuning
• Key coding and immobilizer programming
• Module repair and coding services
• Component adaptation and configuration

2.2 Service Limitations

While we strive for excellence in all services, we acknowledge the following limitations:

• Not all vehicle issues can be diagnosed or resolved through software diagnostics alone
• Some manufacturer-specific protocols may require OEM equipment not available to independent shops
• Vehicle modifications, aftermarket parts, or previous unauthorized repairs may affect diagnostic results
• Success rates for certain procedures (e.g., "all keys lost" scenarios) vary by vehicle make and model

2.3 Customer Responsibilities

Clients are responsible for:

• Providing accurate vehicle information and service history
• Disclosing any previous modifications or repairs
• Understanding that diagnostic services identify issues but do not guarantee repair outcomes
• Following all post-service recommendations for vehicle operation

2.4 Pricing & Payment

All service pricing is quoted before work begins. Prices are subject to change based on complexity discovered during diagnostics.

3.1 License Grant

DACOS (DiagAutoClinic Operating System) is released under the MIT License. You are granted a worldwide, royalty-free, non-exclusive license to:

• Use DACOS for personal or commercial purposes
• Modify, adapt, and create derivative works
• Distribute DACOS in source or binary form
• Sublicense and sell copies of DACOS

3.2 MIT License Terms

Permission is hereby granted, free of charge, to any person obtaining a copy of this software and associated documentation files (the "Software"), to deal in the Software without restriction, including without limitation the rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, and to permit persons to whom the Software is furnished to do so, subject to the following conditions:

The above copyright notice and this permission notice shall be included in all copies or substantial portions of the Software.

CRITICAL SAFETY NOTICE: DACOS interfaces with vehicle control systems. Improper use can result in:

• Vehicle damage or malfunction
• Safety system failures
• Warranty voidance
• Personal injury or property damage

Users assume all risks associated with vehicle diagnostics and programming. Always follow proper safety procedures and manufacturer guidelines.

3.5 J2534 Compliance

DACOS implements SAE J2534 standards for PassThru communication. While we strive for full compliance, users are responsible for verifying compatibility with their specific hardware and vehicle applications.

4.1 Product Information

We make every effort to display accurate product information, including descriptions, specifications, and pricing. However, we reserve the right to correct errors and update information without prior notice.

4.2 Orders & Pricing

• All prices are quoted in South African Rand (ZAR) unless otherwise specified
• Prices are subject to change without notice
• Product availability is not guaranteed until payment is confirmed
• We reserve the right to refuse or cancel any order

4.3 Shipping & Delivery

• Shipping costs are calculated based on destination and product weight
• Delivery timeframes are estimates and not guaranteed
• Risk of loss passes to buyer upon delivery to shipping carrier
• International shipments may incur customs duties and taxes (buyer's responsibility)

4.4 Returns & Refunds

Due to the technical nature of diagnostic equipment:

• Returns are accepted within 14 days of receipt for unused, unopened products
• Software/license products are non-refundable once activated
• Defective products will be replaced or repaired under warranty terms
• Return shipping costs are the buyer's responsibility unless product is defective

4.5 Product Warranties

Hardware products carry manufacturer warranties. We facilitate warranty claims but are not liable for manufacturer warranty fulfillment. Software products are provided "as is" with no warranty.

5.1 Service Warranty

DiagAutoClinic warrants that services will be performed in a professional manner consistent with industry standards. This warranty is limited to re-performing services at no charge if deficiencies are identified within 30 days of service completion.

5.2 No Consequential Damages Warranty

We are not liable for consequential damages including but not limited to:

• Lost profits or business interruption
• Vehicle downtime or rental costs
• Damage to vehicle resulting from pre-existing conditions
• Data loss or corruption

5.3 Third-Party Hardware/Software

We disclaim all warranties for third-party products and software. Manufacturer warranties apply where applicable.

6.1 Exclusions

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

7.1 DiagAutoClinic Trademarks

The DiagAutoClinic name, logo, and branding are proprietary to DiagAutoClinic. Unauthorized use is prohibited.

7.2 DACOS Open Source

DACOS source code is licensed under the MIT License. Contributions to the project are governed by the project's contribution guidelines on GitHub.

7.3 Website Content

Website content, design, and documentation are copyrighted material. Reproduction requires written permission except where explicitly permitted under open-source licenses.

7.4 Human-AI Collaboration Credit

This project represents a collaboration between human expertise and artificial intelligence. This collaboration model is a core part of our identity and should be acknowledged when referencing our work.

8.1 Data Collection

We collect only data necessary to provide services:

• Contact information (name, email, phone)
• Vehicle information for diagnostic purposes
• Service history and diagnostic results
• Payment information (processed securely through third parties)

8.2 Data Usage

Your data is used solely for:

• Providing requested services
• Communicating about services and support
• Improving our services and software
• Legal compliance and dispute resolution

8.3 Data Protection

We implement reasonable security measures to protect your data. However, no method of transmission or storage is 100% secure. You acknowledge and accept this inherent risk.

8.4 Data Retention

We retain customer data for a minimum of 5 years for warranty and legal purposes. You may request data deletion after this period, subject to legal retention requirements.

9.1 Right to Refuse Service

We reserve the right to refuse service to anyone for any reason, including but not limited to:

• Violation of these terms
• Abusive or threatening behavior
• Fraudulent activity or payment disputes
• Requests for illegal modifications or services

9.2 Effect of Termination

Upon termination, you must cease using our services and software (excluding DACOS, which remains licensed under MIT). Outstanding payments remain due.

10.1 Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.

10.2 Modifications to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or website notice. Continued use after changes constitutes acceptance.

10.3 Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.

10.4 Entire Agreement

These terms constitute the entire agreement between you and DiagAutoClinic regarding our services and supersede all prior agreements.
